Terms & Conditions

These Terms of Service (these “Terms”) govern your use of the JC Fit City Website and App (the “Platform”), a communication platform for the JC Fit City Project (“Project”) between the Platform users, the Project co-organisers and The Hong Kong Jockey Club Charities Trust (“the Trust”).

 

The Project is initiated and funded by the Trust to promote Hong Kong’s population’s interest in physical activity. The Project aims to encourage Hong Kong citizens to incorporate sports and exercise into their daily lives with the aim of achieving the World Health Organization's recommended weekly level of physical activity. Through city-wide iconic events and a wide range of low-entry-barrier sports activities, the Project strives to increase citizens’ awareness of the benefits of an active lifestyle and help them build peer support networks through participating in sports. The Project is co-organised by the Hong Kong Playground Association, The Hong Kong Federation of Youth Groups, RunOurCity Foundation, InspiringHK Sports Foundation, the Elite Athletes Charitable Trust and The Education University of Hong Kong (the “Project co-organisers”). The Platform provides a platform for Project activities’ (“Activities”) registration, record and reward redemption.

 

Please read the following Terms carefully before accessing or using the Platform. By using the Platform, you agree to be bound by the Trust’s Privacy Policy Statement and the Terms.  If you do not accept all of the Trust’s Privacy Policy Statement and the Terms, then you should stop accessing the Platform.

 

  1.      Rules of Usage
     
    1.   The Platform is available to a Hong Kong resident who has successfully registered as a user with The JC Fit City Project ("User"). The User login is for the personal use and/or enjoyment of the relevant User only. The User shall be liable for all consequences if he/she allows any person other than himself/herself to use his/her User login information.

 

  1.   Any person who has successfully logged into the Platform as User is deemed to have read and accepted these Terms & Conditions and the Trust’s Privacy Policy Statement (as specified in Rule 12 below). User acknowledges and agrees that all uses of the Platform, despite the actual time and location of the User, shall be deemed to be within the context of use of the Platform and accordingly subject to the Trust’s Bye-laws and other applicable regulations imposed on the Users.

 

  1.   Each User undertakes and ensures that he/she will not, in the course of using any material sharing functionality on the Platform, transmit, distribute or otherwise communicate anything containing any malware or element which may affect the functionality of the Platform; or cause damage to, interfere with, or erode any data or system belonging to the Trust.

 

  1.   In downloading the Platform, each User undertakes not to, or allow any third party to:

 

  1.    make modifications, additions or deletions to or make derivative works of, or
  2.  

  3.    reproduce, distribute, make available, resell, sublicense or otherwise tamper with, any part or the whole of the Platform.

 

  1.   In using all or any part of the contents extracted from the Platform in any form or manner, each User undertakes that:

 

  1.    the extract shall in no event include any marks, trademarks, logo, service marks or otherwise;

 

  1.    such use shall be made at his/her own risks, the Trust is not in any way liable for any incompleteness, loss or corruption of data;

 

  1.     such use shall be for his/her own records or purposes that are not in contravention of applicable laws; and

 

  1.    such use shall not in any way harm, damage and/or bring into disrepute the name, reputation and/or image of the Trust.
     
    1.   Each User acknowledges and agrees that in using the Platform, the relevant mobile service provider may charge certain fees based on the volume of data transmitted and/or charge any other fee as may be agreed between the User and the relevant mobile service provider.

 

  1.   Provision of the Platform howsoever (including sharing the executable file of the Platform) after download to any third party (including any other Users) is prohibited, and notwithstanding such prohibition any acts, costs, expense, loss and damage arising in connection with such provision shall be borne by the providing User.
     
  1.      Local Use

 

  1.   The Platform is intended and provided for use in Hong Kong. The Trust does not guarantee that the Platform can be accessed or used outside of Hong Kong. The Trust is not responsible for any consequences arising from any use outside Hong Kong. The User using the Platform shall be solely responsible for all and any consequences arising from the use of the Platform, whether within or outside Hong Kong by himself/herself, or a third party acting with or without his/her knowledge, consent or authority.

 

  1.   All usages of the Platform are deemed to be made in Hong Kong and subject to the laws of Hong Kong.
     
  1.      Log-in and Security

 

  1.   User may use the Platform as follows:

 

  1.    User shall activate and/or log in to the Platform with the security devices (including without limitation, login username and password, all of which shall be decided subject to the Trust’s parameters and requirements (including without limitation, requirements on length and composition of password) which may be updated from time to time) (“Security Devices”);
  2.  

  3.    Apart from the Security Devices, one-time passwords (OTPs) might also be required for activation or use of the Platform from time to time. User shall acknowledge that his/her mobile service provider may impose restrictions on receiving OTPs via SMS if he/she is outside of Hong Kong or if he/she uses an overseas mobile service network. User’s mobile service provider may also impose service costs for receiving OTPs via SMS. User is solely responsible for paying any such costs levied by the mobile service provider or any other person, and the Trust shall in no event be liable to any Users for any issues and/or costs arising in connection with receiving OTPs via SMS on his/her mobile phone.

 

  1.     Subject to the parameters and requirements in Sub-Rule (a), the User may also update his/her Security Devices from time to time.

 

  1.    Upon successful activation of the JC Fit City App (“App”), User may activate biometric credentials in the form as the Trust may accept for logging in to the App ("Biometric Log-in"). For the avoidance of doubt, the Trust shall have the sole discretion to determine whether:

 

  1.       to confine the scope of permission to any User to log in to the App with or based on his/her biometric credentials in accordance with any requirements, limitations and restrictions as the Trust may deem fit including without limitation, the model and/or the version of the operating system of the device in question, the period wherein such log-in will be impossible;

 

  1.       to accept any form of Biometric Log-in of which the verification mechanism and logics pre-installed in the device as may be used by a User for use of the App ("Device"); and

 

  1.       without prejudice to Sub-Rule (2) above, where the Device is enabled in howsoever manner with various verification mechanisms and logics for the same or different biometric credentials of the Users, to accept which of such mechanisms and logics amongst others. Further to the foregoing, nothing in this Sub-Rule (d) shall render any Security Device invalid and/or preclude the Trust from accepting log-in by the Security Device.

 

  1.   User should keep strictly confidential all information and details in relation to his/her account, including but not limited to the Security Devices (collectively, the “Confidential Information”). All activities conducted with the correct Confidential Information will be binding on the User whether or not such activities were authorised by the User.

 

  1.   Where a User has activated Biometric Log-in for the App:

 

  1.    he/she shall ensure that the biometric credentials stored on the Device are his/her own and only use his /her own biometric credentials for logging in to the App;

 

  1.    He/she shall avoid using any biometric credentials that may be identical or very similar to the biometric credentials of another person (e.g., a User shall not use facial recognition for authentication purposes if he /she has an identical twin sibling), and shall also avoid using facial recognition when his/her facial features may be undergoing changes;

 

  1.     for reasons of security and maintenance of the App, the Trust may collect usage data from the User’s Devices whereon Biometric Log-in has been used; and

 

  1.    Biometric Log-in may be suspended across all his/her Devices and re-activation required if:

 

  1.       the Trust reasonably believes that any of his/her Devices whereon Biometric Log-in has been used has been tampered with or otherwise compromised; or
     
  2.       the Trust deems it necessary or expedient to safeguard the integrity and security of the Platform, including without limitation, due to non-use of Biometric Log-in by the User for such period as determined by the Trust.

 

  1.   Without prejudice to the generality of Rules 3.1 to 3.3, each User shall ensure that the login passwords are private, unique and not generally known to any third party. Each User understands and accepts that the security level will be compromised if the login passwords chosen by the User are known to third parties. The Trust shall not be liable for any loss or damage howsoever arising from any access to any User’s account as a result of any third party who is able to provide the correct login passwords.
     
  2.   In the event the User decides to terminate use of the Platform, the User must deactivate the user account and remove the Platform from all his/her devices forthwith.

 

  1.   Without prejudice to any other part of this Rule 3, the Trust may at any time require compulsory updates of the Security Device of and/or suspension of the Biometric Log-in and reactivation of biometric credentials as the Trust sees fit.

 

  1.   Upon notice or suspicion of any Confidential Information being disclosed to any unauthorised person or any unauthorised person being in possession of such information for whatever reason, the User must immediately notify the Trust through e-mail. Notwithstanding the foregoing and until after the Trust has terminated or accepted termination of use of the User login, all User login by any person, whether or not authorised by the User, shall be binding on the User.
     
  2.   User should beware that there may be, by third party with an intent to deceive or other dishonest intent (irrespective of whether any benefit to such third party will be imminent or not), attempts to impersonate the Trust (including without limitation, by way of bogus sites or application which attempt to pass off as the Trust’s) or hold out as a co-operator involved in the operation of the Platform or any service thereon. Before submitting any personal particulars via any mobile application or service thereon, including but not limited to the Confidential Information, User must ensure that the relevant mobile application and/or service are in fact provided by the Trust. In case of any doubt, User should immediately contact the Trust to verify the authenticity of the mobile application and/or service. The Trust shall not be responsible for any consequences following the User accessing or providing any information to any fake or bogus service provider passing off as and/or claiming to be the Trust or Project co-organisers.
     
  1.      User’s Representations and Warranties

 

  1.   User represents and warrants that all information provided to the Trust is true, accurate and complete to the best of his/her information, knowledge and belief.

 

  1.   Notwithstanding anything contained in these Terms, in the event that a User uses or adapts any contents allowed by the Trust in conjunction with any material of his/her own, User represents, warrants and indemnifies the Trust that such material (a) is not obscene, blasphemous, libellous or defamatory; (b) does not intrude, misuse or abuse another person’s name, portrait or privacy; and (c) is either owned by such User or that use of such material is licenced to such User or will not infringe any third party proprietary right, including intellectual property right. User further undertakes that he/she will not engage in any fraudulent, dishonest, illicit or illegal practice in connection with the use of the software application, their features and their contents.

 

  1.      Activity Management Function

 

  1.   Information regarding the availability of vacancies at the Activities is for information only. Update of such information may be subject to delay and the Trust shall not be liable for any such delay or inaccuracies in the information.

 

  1.   The registration of each Activity may be subject to the terms and conditions of the corresponding organisers. By using the Activity Management Function for such activity, the User is deemed to have accepted the applicable terms and conditions.

 

  1.   All Activities on this Platform are free unless otherwise specified. However, Project co-organisers may impose deposits for Activities. Project co-organisers may also have their own refund policies, so long as they are consistent with and do not limit User’s ability to receive refunds. The Trust is not liable for any fees incurred.

 

  1.   The Platform is accessible to all Platform Users. However, Users under the age of 18 are required to obtain parental or guardian consent in order to register as a User and enrol in any Activity with the Project. Additionally, specific eligibility requirements for particular Activities available on the Platform may be set by Users who have the authority to moderate or manage that portion of the Platform. For instance, the eligibility requirements for an activity may be set by the corresponding organiser(s).

 

  1.   Unless otherwise specified, Activities on this Platform are not hosted by the Trust. When User successfully enrolled and attends any Activity available on Platform, he/she acknowledges and accepts all associated risks and waives any and all claims and causes of action against the Trust, the Project co-organisers and their insurers for any liability in connection with his/her participation of the Activity, including but not limited to personal injury or property damage.

 

  1.   Once User has successfully enrolled in an Activity, transferring User’s enrolment to another person is not permitted. If User is unable to attend the Activity after enrolment has been confirmed, User shall cancel the enrolment on our Platform at least 48 hours prior to the Activity. Failure to cancel the enrolment and being absent from the Activity will be recorded as an absence in our records.

 

  1.   The Trust reserves the right to terminate the use of the Activity Management function, either overall or for specific facilities or Activities, at any time without prior notice.

 

  1.      Rewards

 

  1.   Fit Coins, badges and stamps (“Virtual Rewards”) will only be credited to Users who have successfully registered with the Project.

 

  1.   Virtual Rewards hold no monetary value and cannot be exchanged for cash or be purchased.

 

  1.   Virtual Rewards will only be recorded upon completion and fulfilment of corresponding requirements, such as the successful completion of an Activity or a challenge.

 

  1.   The Trust reserves the right to modify the requirements to qualify for respective Virtual Rewards from time to time.

 

  1.   The Trust reserves the right, from time to time, to establish certain terms and restrictions regarding the use and redemption of Virtual Rewards. Such terms and restrictions will be posted on our Platform.

 

  1.   The accrual period for each Fit Coin is 12 months, starting from the month of acquisition. Fit Coins will expire and will no longer be valid post 12 months of obtaining.

 

  1.   Stamps will expire and become invalid post the challenge deadline indicated on our Platform.

 

  1.   The Trust reserves the right to terminate the use of the Reward function, either generally or for any particular facility or Activity, at any time without notice.

 

  1.      Reward Redemption

 

  1.   The Platform provides a Reward Redemption function which enables Users to redeem certain Virtual Rewards for virtual gifts, gifts, coupons for certain merchandise, e-vouchers, discount codes, donations, etc (“Rewards”). The Reward Redemption function is accessible to all Users. However, Users under the age of 18 may be required to obtain parental or guardian consent for Rewards redemption.

 

  1.   Information regarding the availability of Rewards in the Platform is for information only. Update of such information may be subject to delay and the Trust or Project co-organisers shall not be liable for such delay or any inaccuracy of the information.

 

  1.   The Trust reserves the right to modify the required number of Virtual Rewards for Rewards redemption at its discretion.

 

  1. If any person who has applied to become a member through our Project co-organisers and has not registered with the Project yet, he/she will not be able to redeem Rewards until you are successfully registered as Users. All Rewards redemptions must be made through our Platform. The various methods of collection and enjoyment of the chosen reward will be detailed in the specific terms and conditions for each particular reward.

 

  1.   Users must make redemption requests in the Platform, and undertake that the Rewards are for her or his own personal use only and not for the purpose of re-sale.

 

  1.   Each user can redeem up to two Rewards across any available categories per calendar month. Additionally, each user can redeem up to HKD$200 cash value of coupon and voucher per calendar year.

 

  1.   Once redeemed, Virtual Rewards used cannot be reversed.

 

  1.   The redemption of any Rewards, including their usage, delivery, or collection, will be subject to additional terms and conditions. These terms and conditions will be available on our Platform or provided to you prior to the redemption.

 

  1. The Trust may terminate the use of the Reward Redemption function, either generally or for any particular facility or Activity, at any time without notice.

 

  1.      Peer Activity Functions

 

  1.   Peer activities are initiated by other Users (“Peer Activities”) and are not hosted by the Trust nor the Project co-organisers. When User participates in any Peer Activity available on our Platform, he/she acknowledges and accepts all associated risks. Furthermore, he/she waives any and all claims and causes of action against the Trust, the Project co-organisers and their insurers for any liability in connection with User’s participation of the Peer Activities, including but not limited to personal injury or property damage.

 

  1.   The Trust assumes no responsibility for the content posted by Users or the communications sent by Users through our Platform. If User comes across any content that violates our Terms, User can report inappropriate content to us.

 

  1.   The Trust is not liable for any cancellation of the Peer Activities.

 

  1.      Project Assessment Functions

 

  1.   To assess the impact of the Project, Users will be invited to participate in the Project assessment conducted by Project co-organisers.  Participation in the assessment is voluntary and Users may opt out of the assessment at any time. Project assessment is subject to the terms and conditions set by the corresponding Project co-organiser(s).

 

  1.   Users participating in the assessment (“Participants”) are deemed to have provided consent to the Trust and the Project co-organisers for the use, collection and recording of relevant data required for the Project assessment.

 

  1.   Participants selected for the control group in the assessment will have limited access to most functions available in the Platform (including but not limited to Event management, reward, and Reward Redemption functions) throughout the assessment period. Upon completion of the assessment, these functions will be reactivated for the Participants' accounts.

 

  1.             Liability

 

  1.   Each User acknowledges and accepts that:

 

  1.    the Platform and any functionality and/or content thereon, shall be subject to the Hong Kong Jockey Club’s (the “Club”) general corporate disclaimer (http://www.hkjc.com/home/english/corporate/corp_disclaimer.aspx) without prejudice to the generality of such corporate disclaimer;

 

  1.    the Platform, their features and their contents are to provide free information, and are owned by or licensed for use by the Trust;

 

  1.     the transmission of information over the internet may not be secured or stable, User accepts the risk of sending sensitive or confidential information over the internet (particularly when such are not encrypted);

 

  1.    the use of the Platform may be subject to interruption, interference, hacking, transmission failure or delay;

 

  1.    where the contents of the Platform contain views or opinions expressed by entities other than the Trust, the Trust does not represent those views or opinions to be the Trust’s views or opinions or that the Trust endorses them;

 

  1.      access to and use of any third-party website/application linked to the Platform is at User’s own risk and discretion and subject to the terms and conditions applicable to such use/access, and by allowing or providing hyperlinks to such third-party websites/applications, the Trust does not hold out and shall not be deemed to endorse, recommend, approve, guarantee or introduce any such third parties, their websites/applications or the service/products they provide on their website/application, or have any form of cooperation with such third parties and websites/applications. Further, the User accepts that the Trust is not party to any contractual arrangements entered into between any User and the providers/hosts of the external website/application (regardless of the subject matter of the relevant arrangement) unless otherwise expressly specified or agreed to by the Trust;

 

  1.    the Trust makes no representation regarding the integrity, compatibility or scalability of the Platform;

 

  1.    the Trust makes no representation regarding non-infringement, security, accuracy, completeness, fitness for a purpose or computer viruses-free of the Platform, its features and contents, and it is each User’s sole responsibility to ensure adequate protection has been put in place for the other programmes, information and data in the device on which the Platform is used and taking reasonable and appropriate precautions to scan for malware and to back up such other programmes, information and data; and

 

  1.       the Trust reserves the sole and all rights to make decisions relating to any information and activity provided, advertised or promoted through the Platform, and may amend, modify, postpone or cancel any content of such information and activity (including but not limited to venue, date, time, performance or other activities, entry requirements, gift, discount or other offerings) or amend the relevant terms and conditions, at any time without notice, and without liability for refund, compensation or otherwise.

 

  1.   Each User agrees that the Trust and the Project co-organisers shall not be responsible for:

 

  1.    any loss, damage, injury or any other form of compromise of any User’s interests, howsoever arising from or caused by the Platform, whether related to any information on or facilities of the Platform, including without limitation, any problem or technical malfunction, any damage to any User’s device, any failure, delays or interruptions in transmission, operation or communication; hacking, distortion or erosion of data or instructions; and any errors or omissions in or from the contents on the Platform;

 

  1.    any disputes/matters relating to the charges of data transmission between the User and mobile service providers;

 

  1.     any use of all or any part of the contents extracted from the Platform (whether incorporated with any third-party materials or otherwise);

 

  1.    any loss, costs, damage or injury as a result of any use or reliance on the Platform and/or their features and/or contents;

 

  1.    any loss, costs, damage or injury as a result of any access to or use of any third-party website/application linked to the Platform and/or any services/products provided thereon, and/or any dispute (whether contractual or otherwise) between any such third party and any User; and

 

  1.      any other loss or damages that may be suffered by a User for any reason whatsoever in using the Platform.

 

  1.   Each User using the Platform shall indemnify and hold the Trust harmless against all claims, losses, expenses and damages (including all legal costs) which arise from the breach of or failure to fulfil any of the Terms herein.

 

  1.             Termination

 

  1. The Trust may, at any time and without giving any reason, suspend or terminate any User’s right to use the Platform.

 

  1. Without prejudice to the generality of the foregoing, the Trust may (a) conduct periodical reviews and suspend or close any account where any irregular or illegal activity is suspected, (b) without prior notice, suspend or terminate any User’s right to use the Platform if the Trust believe or suspect that the relevant User has allowed any other person to use the Platform.

 

  1.             Personal Data and Privacy

 

  1. Each User undertakes to read and understand the Trust’s Privacy Policy Statement (https://www.hkjc.com/home/english/corporate/corp_privacy_hkjcct.aspx) before downloading or using this Platform, and consents to the Trust using any personal data gathered from his/her usage of this Platform in accordance with the Trust’s Privacy Policy Statement.

 

  1. The Trust is committed to ensuring the privacy and security of the personal data it holds and aims to meet this commitment by implementing the principles and requirements of the Personal Data (Privacy) Ordinance of the Hong Kong Special Administrative Region (“the Ordinance”).

 

  1. The Trust reserves the right to update, amend or modify the terms of the Privacy Policy Statement or any part of it without prior notice, and User’s continued access and/or use of this Platform signifies his/her acceptance of the updated, amended or modified Privacy Policy Statement, unless if the changes reduce User’s rights in which case the Platform will ask for his/her consent. If User does not agree to all the terms and conditions in the Privacy Policy Statement and/or any subsequent updates, amendments or modifications thereto, User must stop accessing or otherwise using this Platform.

 

  1. Throughout User’s usage of the Platform, the Platform may request, collect, process and/or disclose personal data from User when User accesses and/or use the Platform. Such data may include personal information related to or linked to a specific individual such as mobile phone, e-mail address, emergency contact information or any such information the Platform has requested and User has provided through this Platform (“Personal Information”). It is obligatory that User provides any personal data requested by the Platform unless User is informed otherwise on or before collection by the Platform. Failure to supply such data may result in the Platform being unable to carry out its operational functions or provide services. The purposes for which User’s personal data may be used include the following:

 

  1.    Administer User’s Activities arrangements, such as registering for Activities, rescheduling and cancellation (once available);

 

  1.    provide user support such as responding to User’s enquiries and requests;

 

  1.     operating our User registration system, such as processing User’s registration and to ensure that User gets the benefit of our system, including to track User’s earning and redemption of Fit Coins, Badges and Stamps, User’s accrual and redemption activities.

 

  1.    To administer campaigns, contests and sweepstakes conducted by us when User chooses to participate in them, including disclosing the winners of any such contest;

 

  1.    providing specified information;

 

  1.      details of User’s usage of the Platform (including but not limited to traffic data, location data, length of user sessions, language, mobile device model, etc.);

 

  1.    information automatically collected and stored in the Platform’s server by using or accessing the Platform (including the log-in username and password for User’s account, pages visited, etc.); and

 

  1.    any other purposes as may be agreed to between User and the Platform, including the purposes set out in any terms and conditions for the engagement by the Platform.

 

  1.      There may be links present on this Platform which could result in User leaving this Platform and/or being taken to other websites. User should note that any Personal Information that he/she provides to those websites is subject to other Personal Information Collection Statement applicable to those websites, and the Platform is not liable for any losses, damages, costs or expenses which User may suffer or incur in connection with him/her providing or making available Personal Information or other data to such websites.

 

  1.      The Personal Information and other data collected from User may be transferred to, processed, and stored in Platform servers. The personal Information will be stored as long as is necessary to fulfil any of the purposes described in the Privacy Policy Statement and these Terms, or to comply with any contractual or legal requirement.

 

  1.      The Platform will use reasonable endeavours to maintain appropriate physical, electronic and organisational procedures to ensure that User’s Personal Information and other data is treated securely and in accordance with the Privacy Policy Statement and these Terms, and to protect such data against unauthorised access or unauthorised alteration, disclosure or destruction of data.

 

  1.      Once the Platform has received User’s information, the Platform will use strict procedures and security features to try to prevent unauthorised access. The Platform does not give any representation, warranty or undertaking that the Personal Information User provide will be secure at all times, and to the extent the Platform has fulfilled its obligations under no circumstances shall the Platform be responsible for any losses, damages, costs and expenses which User may suffer or incur arising from unauthorised access to or use of User’s Personal Information.

 

  1.     User is responsible for keeping own chosen password confidential and not to share the password with any third party.

 

  1. Under the Personal Data (Privacy) Ordinance, User has a right to request access to, and to request correction of, his/her personal data held by the Platform. Alternatively, User may make data access, correction or erasure requests by sending his/her request by email to jcfitcity@hkjc.org.hk.

 

  1. Where mandatory under applicable legislation, User may also request restriction of processing of Personal Information or object to processing by sending his/her request or objection by email to jcfitcity@hkjc.org.hk. User may also request a copy of the information that the Platform holds about the User by sending the request by email to jcfitcity@hkjc.org.hk.

 

  1. User may send email to jcfitcity@hkjc.org.hk if he/she has a complaint regarding the processing of his/her Personal Information.

 

  1. When handling a data access or correction request, the Platform has the right to check the identity of the requester to ensure that he/she is the person entitled to make the data access or correction request.

 

  1. All handling of personal data will be governed by the most recent version of the Privacy Policy Statement , available at https://www.hkjc.com/home/english/corporate/corp_privacy.aspx and these Terms. If there is any inconsistency or conflict between the English and Chinese versions, the English version shall prevail.

 

  1. User can manage or edit his/her personal details in his/her account. If User no longer wish to participate in the Project, User may permanently delete his/her account. Please note that upon we received confirmation to "Delete Account", all personal data associated with his/her account will be permanently deleted and cannot be recovered.

 

  1. Unless with the User’s prior written consent, health-related Data collected by the Platform, including but limited to daily step counts, distance travelled, sleep pattern, flights climbed and/or energy consumed, etc., will not be transferred to third parties, except for the purpose of providing or enhancing the Platform's functionality or service.

 

  1.             Amendment

 

  1.      The Trust shall have the right to add to, delete, amend or vary any of these Terms in its absolute discretion. In the event of disputes, the Trust’s interpretation shall be final and conclusive.

 

  1.      Notice of any such additions, deletions, amendments or variations and the day upon which such shall become effective shall be deemed to have been duly given to each User if a notice thereof is posted on the Platform.

 

  1.      Use of the Platform on or after the date upon which any such addition, deletion, amendment or variation is expressed to take effect will be deemed to constitute acceptance thereof by the User without reservation.

 

  1.             Breach of these Terms

 

  1.    A breach of these Terms and/or any other rules in relation to the use of the Platform shall constitute a breach of the Trust’s rules and regulations and may result in disciplinary consequences.

 

  1.    Upon termination by the Trust of a User’s right to use the Platform as a result of any breach of any of these Terms, the Trust may, but shall not be obliged to, close his/her account and/ or terminate his/her User login.

 

  1.             Chinese and English Versions

 

  1. All terms and conditions in respect of use of any part of the Platform are written in Chinese and English. In the event of any inconsistency between the Chinese version and the English, the English shall prevail.
